Depositors agreement

1. Terms of the Deposit

1.1 The depositor confirms that they are the legal owner of the records, or has the permission of the legal owner to donate these records, and agrees to provide proof of ownership if requested by the Archive.

1.2 Depositor information will be kept by the UK Centre for Carnival Arts and processed in accordance with the Data Protection Act 1998. It will be treated as confidential and used only for internal management of the archive collections. The Archive will not give out depositor details to third parties without the consent of the depositor.

1.3 It is the responsibility of the depositor to notify The National Carnival Archives in writing of any change in name or address of the depositor or owner of these records.

1.4 This agreement does not override the rights of the creator over the material. The creator retains the right to use their material as they see fit, without giving notification to the Archive.

1.5 The Archive will not sell or licence the rights to any material donated without the permission of the depositor.

2. Access

2.1 It is the intention of the National Carnival Archives to provide the general public with full online access to archival material, subject to relevant legislation, including the Data Protection Act 1998.

2.2 The Archive also intends to use the material to promote the Archive, the UK Centre for Carnival Arts and the carnival industry.

2.3 By signing this agreement you are agreeing to grant the National Carnival Archives a non-exclusive, non-commercial worldwide license, for the duration of the materials copyright, to reproduce, adapt, transmit, publicly display, distribute and publish on the Internet the videotapes, photographs, and textual materials deposited, for educational purposes and for the promotion of Carnival Arts and the UK Centre for Carnival Arts.

3. Accreditation

3.1 A citation to the creator of the material will always be included where possible.

4. Storage

4.1 Digital copies of the records will be made where possible and the original returned to the owner. The timescale for this will depend on the size of the deposit and should be discussed with the archivist.

4.2 The records will be catalogued and, if requested, a copy of this list can be sent to the depositor when complete. Ownership and copyright of all such lists and subsequent finding aids remains the property of The National Carnival Archive.

4.3 The National Carnival Archive will take all reasonable precautions to preserve the records from damage, theft or loss but shall not be liable beyond this for any damage, loss or theft of the records that occurs whilst they are in the care of the archive.

4.4 The archive may electronically store, copy or re-arrange material to ensure its future preservation and accessibility e.g. to ensure they can be read by future computer systems.
